TERMS & CONDITIONS

1. General

1.1 These are the General Terms and Conditions of ANNA van MILLS B.V., a private limited company incorporated under the laws of the Netherlands. ANNA van MILLS B.V. is situated at Keizersgracht 241, 1016 EA Amsterdam in the Netherlands. Email: info@annavanmills.com. Registered with the Chamber of Commerce in Amsterdam under No. 61105147. Tax (VAT) number: NL854208331B01.

2. Agreement / order

2.1 These general terms and conditions apply to every offer of ANNA van MILLS B.V. and each agreement concluded between ANNA van MILLS B.V. and customer.

2.2 The agreement between ANNA van MILLS B.V. and the customer is concluded via the website of ANNA van MILLS B.V. (“www.annavanmills.com ‘). By checking the box “I agree to the general terms and conditions” the customer agrees to the content and its applicability to the agreement which the customer concludes with ANNA van MILLS B.V.

2.3 ANNA van MILLS B.V. guarantees that the supplied product meets the agreement and complies with the specifications listed in the offer.

2.4 ANNA van MILLS B.V. reserves the right to limit larger quantities of shoes ordered by a customer.

3. Delivery

3.1 Under the rules of distance selling orders, ANNA van MILLS B.V. will deliver orders at least within 30 days, unless a different delivery date is agreed.

3.2 Under the rules of distance selling orders ANNA van MILLS B.V. will deliver orders at least within 30 days, provided that all shoe components – needed to produce the “made-to-order” shoes – are in stock or unless another delivery date is agreed.

3.3 If delivery within 30 days or other agreed delivery date is not possible, the customer will be informed at the latest within 7 days after placing the order.

3.4 Subject to evidence of the contrary, the delivery obligation of ANNA van MILLS B.V. will be fulfilled as soon as the goods delivered by ANNA van MILLS B.V. have been offered to the customer once. For home delivery, the report of the carrier is full proof that the goods have been offered for delivery.

4. Prices

4.1 During the term of the offer, the prices will not be increased.

4.2 All prices on the site are in Euros and inclusive of 21% VAT.

5. Approval period / refund purchase price

5.1 Please note: all shoes of ANNA van MILLS B.V. are created “made-to-order” for the customer according to the personal specifications given by the customer. As a result, a refund of the purchase price is not possible.

5.2 ANNA van MILLS B.V. applies an approval period of 14 days after the receipt of the order by the customer. If within the period of 14 days after receipt the customer has not declared to invoke the ANNA van MILLS B.V. return policy, the purchase is a fact.

6. Return policy

6.1 Grounds for return.

If the shoes do not meet the expectations of the customer on the bases of one or more of the three reasons mentioned below, the customer may use the ANNA van MILLS B.V. return policy.

# 1. Not the right size or fit.

The shoes received by the customer do not fit.

# 2. The design of the shoes received by the customer does not match the 3D images on the website.

By using the most advanced 3D technology, our design configurator renders a photorealistic depiction. All 3D colors and materials are virtually the same as in real life. Nevertheless, factors such as monitor type and lighting affect this and a small deviation between the 3D images and the physical design received by customer may be possible.

# 3. There is a manufacturing defect (guarantee).

Should there appear to be a manufacturing defect, the problem may manifest itself at a later stage. In these cases, ANNA van MILLS B.V. applies a warranty period of 6 months after receipt of the shoes. This guarantee does not apply if:

  1. The customer is in default towards ANNA van MILLS B.V.;
  2. The customer has repaired and/or altered the delivered shoes him/herself or has had it repaired/altered by third parties;
  3. The delivered shoes have been exposed to abnormal conditions or have otherwise been handled carelessly or handled contrary to the instructions of ANNA van MILLS B.V. and/or the maintenance instructions on the website.

With regard to the adjustment of the shoes ANNA van MILLS B.V. recommends the following:

  • It can occur that your feet are a little swollen at the end of the day as a result of the strain during the day. Therefore, we always recommend fitting the received shoes at the beginning of the day.
  • Always fit the shoes on a clean and soft surface to ensure that no damage is caused to the shoes.
  • ANNA van MILLS B.V. recommends that the customer tries on and examines a prototype of the desired shoe model beforehand. An appointment to discuss the possibilities can be made via our contact form on the website or by sending an email to info@annavanmills.com. In addition, we advise to view the “shoe size table” on the website.

6.2 Return procedure.

In all cases described in article 6.1 (Reasons for return), the following return procedure applies:

  • Customer must contact ANNA van MILLS B.V. within 14 days of receipt of the shoes. Contact can be made via the contact form on the website or by sending an email to info@annavanmills.com, with reference to the order number and a clear reason for the return.

In the case of warranty, the customer should file the complaint in writing to ANNA van MILLS B.V. within 6 months of receipt of the shoes, in order to discuss the possibilities of repair, modification or replacement of the shoes.

  • ANNA van MILLS B.V. will evaluate and respond to the complaint within 48 hours after receipt of the complaint, in which case there are three possible solutions:
  1. Acceptance of return by ANNA van MILLS B.V. after which the shoes will be adjusted for the customer free of charge;
  2. Acceptance of return by ANNA van MILLS B.V. after which the customer will receive a new pair of shoes in a different size, with the same design;
  3. Acceptance of return by ANNA van MILLS B.V. after which the customer will receive a new pair of shoes of a different design and/or in a different color.
  • The customer should return the shoes to the address mentioned below, unworn and undamaged, within 30 days of receipt of the answer from ANNA van MILLS B.V.:

Return costs are at the expense and risk of the customer. We therefore recommend to send the package insured and including a track & trace code. For rates for returns, we refer to the following websites of potential carriers. For the return of packages within the Netherlands, we refer to the website of PostNL:

ANNA van MILLS accepts no responsibility for lost returns.

  • Shoes should be returned in the original packaging, including accessories and documentation. Any free items sent by ANNA van MILLS B.V. should also be returned.
  • ANNA van MILLS B.V. reserves the right to decline incomplete returns.

Please note! Shoes that have been damaged due to negligence by the customer or shoes that have been worn by the customer, will not be modified or replaced free of charge.

7. Privacy

7.1 If the customer places an order with ANNA van MILLS B.V., his/her data will be added to our customer base.

7.2 ANNA van MILLS B.V. adheres to the rules and regulations of the law, with respect to privacy and will not provide customer information to third parties. Also review our privacy policy on the website.

7.3 In some cases we use a mailing list, provided that ANNA van MILLS B.V. obtained an authorization from the customer for that purpose.

8. Offers

8.1 Verbal agreements are only binding for ANNA van MILLS B.V. after they have been confirmed explicitly and in writing.

8.2 Offers of ANNA van MILLS B.V. do not automatically apply to reorders.

8.3 Additions, modifications and/or further agreements are effective only if agreed in writing.

9. Images and specifications

9.1 All images (photos, drawings, information on shoe models, sizes, colors, etc.) on the website of ANNA van MILLS B.V. are an approximation and are therefore indicative. For this reason, listings may not give rise to damages or cancellation of the contract.

10. Retention of title

10.1 Ownership of all shoes delivered by ANNA van MILLS B.V. to the customer, remain with ANNA van MILLS B.V. as long as the customer has not met its obligation towards ANNA van MILLS B.V. under the agreement or under previous similar agreements.

10.2 The shoe designs made available by ANNA van MILLS B.V. remain the property of ANNA van MILLS B.V., regardless of the version composed by the customer.

11. Applicable law/jurisdiction

11.1 All agreements are subject to Dutch law.

11.2 Disputes arising from an agreement between ANNA van MILLS B.V. and the customer, which cannot be resolved by mutual agreement, will be decided by the competent court in the district of Amsterdam, unless ANNA van MILLS B.V. prefers to submit the dispute to the competent court of the domicile of the customer.
